HHS OIG Releases Report on Potential Drug Misclassifications

In conclusion, the report recommended that CMS (1) follow up with manufacturers associated with potentially-misclassified drugs identified in this report to determine whether current classifications are correct, (2) improve its Drug Data Reporting for Medicaid System to minimize inconsistent data submissions and track potential classification errors for follow up, and (3) pursue a means to compel manufacturers to correct inaccurate classification data reported to the Medicaid rebate program. CMS concurred with all three recommendations.   Correction:  Our story published January 8, 2018  New Jersey Finalizes “Gift” Ban of Physicians Working with the Pharmaceutical Industry we originally reported the $15 meal cap was 4 times a year  from an individual company.    That section was in the proposed rule but not in the final rule.  The final rule eliminated the frequency limit but still, a $15 cap on the cost of a meal remains and the article has been corrected online.  Looks like NJ physicians will be getting meals courtesy of pharmaceutical manufacturers from Duncan Donuts, Taco Bell and McDonald's.  Thanks to our readers for bringing this to our attention       Related StoriesOIG Asks CMS to Track Medicare Costs from Device FailuresOIG Faults CMS for Improper Payment RatesEffectiveness, The Holy Grail of Compliance - Both the DOJ & OIG Weigh In
