La télémédecine au Québec : état de la situation des considérations légales, juridiques et déontologiques

Conclusion Pour que la télémédecine puisse réussir à intégrer le continuum de soins et faire partie intégrante de la routine clinique, il est primordial qu’elle puisse disposer d’un cadre juridique suffisamment flexible pour répondre adéquatement aux exigences d’une réalité qui évolue rapidement. Context In Quebec, telemedicine services are implemented to ensure an equitable access to health care and services for the population, especially in rural and distant areas. However, the challenge faced by telemedicine is to successfully integrate the continuum of care and services. Currently, many projects barely exceed the pilot phase. One of the factors that could explain this situation relates to the many legal and judicial questions that still surround telemedicine today. Objectives This article aims to discuss and analyze the legal and ethical issues associated to the use of telemedicine in medical practice in Quebec. Methods Analysis of legal and law texts as well as the Code of Medical Ethics of Quebec, accompanied by a review of general literature on the legal aspects of telemedicine; interviews and discussions with experts in telemedicine, both health professionals and jurists.
